Terms and Conditions
The Honey Cakes – Medovik
Please read these Terms and Conditions carefully. By placing an order, you agree to be bound by these Terms.
1. Business Details
The Honey Cakes – Medovik operates as a home-based food business in accordance with Victorian food safety regulations.
2. Orders and Acceptance
All products are made to order. An order is only confirmed once payment is received or otherwise agreed in writing.
We reserve the right to accept or decline any order.
A minimum lead time of 48 hours applies unless otherwise agreed.
3. Pricing and Payment
All prices are in AUD and [include GST / exclude GST – choose one]
Full payment is required to secure an order unless agreed otherwise
Prices may change at any time prior to order confirmation
4. Changes to Orders
Changes must be requested at least 72 hours before collection/delivery
We will attempt to accommodate changes but do not guarantee availability
Changes requested within 72 hours may be declined
5. Cancellations and Refunds
Due to the made-to-order nature:
Orders within 48 hours → non-refundable
Cancellations within 72 hours → non-refundable
Cancellations before 72 hours → refund at our discretion
No refunds for change of mind
Nothing in this clause excludes your rights under the Australian Consumer Law (ACL).
6. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to:
a replacement or refund for a major failure, and
compensation for any other reasonably foreseeable loss or damage
If a product fails to meet a consumer guarantee, we may choose to:
replace the product, or
provide a refund
7. Customer Satisfaction and Claims
If you believe there is an issue with your order:
You must notify us as soon as reasonably possible
The product must be returned for inspection
We may refuse a refund or replacement if:

the product is not returned

it has been consumed, damaged, or mishandled
8. Allergens and Dietary Information
Our products may contain or come into contact with:
- dairy
- gluten (wheat)
- eggs
- nuts
We operate in a home bakery kitchen and cannot guarantee absence of cross-contact.
Customers with allergies consume products at their own risk.
9. Storage and Shelf Life
Products must be refrigerated
Best consumed within 3–5 days
We are not responsible for issues resulting from:
- improper storage
- transport after collection
- handling after delivery
10. Collection and Delivery
Times must be agreed in advance
Customers must ensure correct address and access
We are not responsible for delays due to:
- traffic
- weather
- access issues
- incorrect information provided
If delivery fails due to customer error, redelivery may incur additional charges.
11. Design and Product Variations
All cakes are handcrafted.
Variations in:
- decoration
- colour
- size
- finish
are normal and do not constitute a fault.
12. Limitation of Liability
To the maximum extent permitted by law:
- replacement of the product, or-
refund of the purchase price
We are not liable for:
- indirect or consequential loss
- loss of profit
- third-party damages
Nothing in this clause limits rights under the Australian Consumer Law.
13. Force Majeure
We are not liable for failure or delay due to events beyond our control, including:
- equipment failure
- illness
- power outages
- supply disruptions
Where possible, we will offer rescheduling, or refund.
14. Intellectual Property
All designs, branding, images, and content remain the property of The Honey Cakes – Medovik.
They may not be reproduced without permission.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia.
